(registered office: 1054 Budapest, Honv\u00e9d utca 8., tax number: 26122117-2-41), as Organiser and data controller, organises the game (hereinafter: Prize Draw) defined in these rules and privacy notice (hereinafter: Rules).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">RULES AND PRIVACY STATEMENT<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>I. Conditions of participation<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Prize Draw is open to those who have legal capacity, or are not subject to any restriction limiting their legal capacity in this respect, who accept the Rules, provide their personal data to the Organiser, register and take part in the Prize Draw according to the mechanism set out in these Rules, and who have a registered place of residence in Hungary (hereinafter: Participant).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If a Participant registers or wins who registered on Facebook or Instagram in breach or circumvention of the Facebook and Instagram terms of use, they will be automatically excluded. The Organiser may exclude from the Prize Draw any Participant who has provided their personal data incorrectly or has not provided them.<br>It is the Participant&#8217;s responsibility to monitor, in good time, the messages arriving at the e-mail address they have provided and the notification concerning the announcement of the results.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the Participant does not collect the prize that has been dispatched, they will not be able to receive the prize and will be excluded from the game.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Organiser accepts no liability for the consequences of the Participant&#8217;s failure to act, and in particular does not grant Participants an extended deadline.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Participant may take part in the Prize Draw under the full name shown in an identity document (primarily an identity card) or under another name suitable for proper identification.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the Prize Draw, no other person may be registered in place of or on behalf of the original Participant, even by way of correction.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Employees of the Organiser, as well as the relatives of such persons as defined in Ptk. 8:1. \u00a7 point 2 (Hungarian Civil Code), are excluded from the Prize Draw. Participation in the Prize Draw constitutes automatic acceptance of these Rules.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If a Participant registers who registered for the Prize Draw in breach or circumvention of the provisions of these Rules, they will be automatically excluded. The Organiser may also exclude from the Prize Draw any Participant who has otherwise provided their data incorrectly or misleadingly, or has not provided them. An excluded Participant may not claim a prize, and must return any prize already handed over, or reimburse its value, to the Organiser.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Opening the website or application may involve data traffic, the possible cost of which is borne by the Participant; the amount of that cost may depend on the Participant&#8217;s internet service provider, the tariff of the service and its structure.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>II. Duration of the Prize Draw<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Duration of the Prize Draw: until midnight on 13 December 2023 (in these Rules: the game period).<br>The draw and the announcement of the results will take place no later than 15 December 2023; the results will be announced in a comment under the post.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>III. How the Prize Draw works<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Prize Draw can be entered during the game period on the Facebook pages of Fagnes, Pomanders and Essential Heal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">During the game period, the Participant completes the tasks set out in the post announcing the game.<br>By doing so, the Participant expressly accepts these Rules and the data processing statement contained in them.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>IV. Draw<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Organiser draws the prizes at random with the help of a computer algorithm.<br>During the Prize Draw, the Organiser announces one winner from among the Participants for each prize.<br>A Participant may be drawn for at most one prize. If a Participant were to be drawn for more than one prize, they will be entitled to the prize drawn first in time. The Participant drawn as winner is entitled to collect the prize. Should it turn out that they are nevertheless not entitled to it, they will be replaced by the reserve Participant drawn in second place by the Organiser, if any, or by any further reserve Participant drawn in a subsequent place. In the notification to that effect, the Organiser sets appropriate deadlines.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>V. Prizes<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">During the Prize Draw, for its duration, Participants may win the following prize:<br>1 Fagnes, Pomanders and Essential Heal gift package with a total value of nearly HUF 80,000, containing: a Pomanders Palo Santo Scented Bracelet: value and Pomanders Palo Santo Soap, Pomanders Christmas Candy Gemstone Earrings with Rock Crystal, an Essential Heal Happy Nose blend, Eucalyptus and Bergamot essential oils, a Fagnes Relax Om Aroma Diffuser in white, and Fagnes Organic Prickly Pear Body Lotion.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A Participant may be entitled to at most one prize, as set out in Section IV.<br>The Organiser reserves the right to change the prize available in the Prize Draw at any time, without giving reasons, prior notice, compensation or redress.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>VI. Collecting the prize<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The winners will be notified by message from the Facebook pages of Fagnes, Pomanders and Essential Heal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The winning Participant provides the details needed for handing over the prize (in particular their postal address and telephone number) in the form of a reply message.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The winning Participant notified in accordance with these Rules must contact the Organiser within 48 hours of being contacted. This deadline is a forfeiture deadline: if it is missed, the Participant loses their entitlement to collect their prize, and the Organiser expressly excludes any obligation to compensate arising from the Participant&#8217;s failure to act.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where necessary, the Organiser will invite the winning Participant to further consultation.<br>The winning Participant may collect the prize by post. The Organisers accept no liability for any damage to, defect in, shortfall in or non-arrival of the consignments occurring after they have been posted.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the winning Participant has limited legal capacity, they are entitled to deal with matters relating to the prize and to collect the prize only together with their legal representative.<br>The prizes are not transferable to others and cannot be exchanged for cash or for another prize.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>VII. Exclusion of a Participant from the game<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Organiser is entitled, at its own discretion and without separate notice, redress, compensation or reasons, to exclude from the Prize Draw any Participant or Participant registration:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>who breaches any provision of these Rules;<\/li>\n\n\n\n<li>who is not, or would not have been, entitled to take part in the Prize Draw, in particular if their registration does not meet the requirements set out in these Rules or otherwise infringes the law;<\/li>\n\n\n\n<li>who is an employee of the Organiser, or a relative of such persons as defined in Ptk. 8:1. \u00a7 point 2;<\/li>\n\n\n\n<li>who in any way breaches the provisions of these Rules, or in connection with the Prize Draw otherwise infringes the law or the rights and\/or legitimate interests of others, or where there is a reasonable suspicion of this;<\/li>\n\n\n\n<li>who acts in a misleading manner in connection with the Prize Draw;<\/li>\n\n\n\n<li>who has not provided the necessary personal data, or the information and statements requested by the Organiser, or who withdraws their consent to data processing;<\/li>\n\n\n\n<li>who does not contact the Organiser within the specified deadline;<\/li>\n\n\n\n<li>who sends false or incorrect personal data to the Organiser, or whose intention is otherwise directed at entitling a fictitious person, or a person other than the real Participant, to a prize in the Prize Draw, or at having a person other than the original Participant registered as a Participant; and<\/li>\n\n\n\n<li>whom, or which, the Organiser sees fit to delete for any other reason, in particular if the Participant would not have been entitled to register on Facebook or Instagram, or infringes the Organiser&#8217;s legitimate economic interests through their comments or statements.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><br>If a Participant is excluded, that Participant may not claim a prize or, if the reason for exclusion comes to the Organiser&#8217;s attention after the prize has been handed over, must return the prize already handed over or, if it has already been used, its equivalent value to the Organiser, and must also reimburse the Organiser for its costs and any damage relating to the exclusion.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Organiser reserves the right, at its own discretion, to announce another Participant as winner in place of the excluded Participant, but cannot be obliged to do so.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the event of a suspicion of a breach of the Rules, or of a fact, circumstance or piece of information giving grounds for exclusion, the Organiser will, within its means, conduct a reasonable and proportionate investigation and make its decision on the basis of the information that came to its attention during the investigation. The Organiser is unable to take into account comments or information received after the investigation has been closed.<br>The Organiser is entitled to decide on exclusion regardless of whether the fact, circumstance or information giving grounds for it arose, or came to its attention, during the Prize Draw or after it. Exclusion proceedings may be initiated no later than 7 September 2020; after that date the Organiser is unable to examine the possibility of exclusion.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>VIII. Liability of the Organiser<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Organiser accepts no liability for the consequences of the Participant&#8217;s failure to act.<br>As the service is free of charge, the Organiser does not guarantee that the Prize Draw will run without interruption, nor can it be held liable for the suspension or termination of the Prize Draw. The Organiser endeavours to remedy any disruptions or operational problems arising during the Prize Draw and during the operation of the Prize Draw&#8217;s page and application, but cannot be held liable for them. The Organiser excludes all claims for damages or compensation in respect of costs, damage or losses arising from or related to participation in the Prize Draw, the Prize Draw itself and, in particular, any errors, deficiencies or malfunctions of the software used, or delays occurring during the Prize Draw. With regard to the prize \u2013 given that it is free of charge \u2013 the Organiser in particular provides neither warranty nor guarantee, and excludes all claims for damages or reimbursement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Organiser reserves the right to terminate the Prize Draw during the game period without giving reasons. The Organiser will inform Participants of such a decision on the Prize Draw&#8217;s Facebook and Instagram pages.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>IX. Privacy statement<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pursuant to Section 20 (20. \u00a7) of the 2011. \u00e9vi CXII. t\u00f6rv\u00e9ny on the right to informational self-determination and on freedom of information (Act CXII of 2011; hereinafter: Infotv.), we inform the Participant that the provision of the data requested by the Organiser for participation in the Prize Draw is voluntary and based on the Participant&#8217;s consent.<br>By taking part in the Prize Draw and by providing their data, the Participant expressly consents in writing to the processing of the following personal data for the purpose of conducting the Prize Draw and handing over the prize, and the Participant expressly consents in writing to their wish list and name being made known to their Friends taking part in the Prize Draw, for the purpose of conducting this Prize Draw and to the extent necessary for that purpose.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">During the Prize Draw, the Organiser processes the following personal data provided by the Participant on the basis of the law and the Participant&#8217;s consent, pursuant to Infotv. 5. \u00a7 (1) a) (Section 5(1)(a) of the Infotv.), for the purpose of conducting the Prize Draw and handing over the prize, and deletes them from its system after the 30th day following the prize draw:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>name,<\/li>\n\n\n\n<li>Facebook and\/or Instagram username,<\/li>\n\n\n\n<li>postal address,<\/li>\n\n\n\n<li>telephone number.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><br><strong>X. Amendment of the Rules<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Organiser reserves the right to amend the Rules. The Organiser will notify Participants of any amendment of the Rules via the Prize Draw&#8217;s Facebook and Instagram pages.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>XI. Miscellaneous provisions<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the Participant has limited legal capacity but is not subject to a restriction limiting their legal capacity in respect of this Prize Draw, they are entitled to use the Application and to take part in the Prize Draw only with the consent of their legal representative.<br>For the purposes of these Rules, a Facebook or Instagram message qualifies as written form.<br>The Participant must bear the consequences of having provided their personal data incorrectly.<br>The Organisers declare that the Prize Draw does not fall within the scope of the 1991. \u00e9vi XXXIV. t\u00f6rv\u00e9ny on the organisation of gambling (Act XXXIV of 1991).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These Rules are governed by Hungarian law.<\/p>\n\n","protected":false},"excerpt":{"rendered":"<p>December 2023 Fagnes T\u00e9rillatos\u00edt\u00e1s Kft.
